Child Pornography
According to federal law, child pornography is defined as any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where:
- the production of the visual depiction involves the use of a minor engaging in sexually explicit conduct; or
- the visual depiction is a digital image, computer image, or computer – generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; or
- the visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct.
Child pornography is highly pursued and investigated by federal and state agencies. Prosecution under federal laws can be extremely strict. There are several cases in which a situation may be misinterpreted as child pornography. When such an accusation occurs, you need the best attorneys on your side. Contact George B. Dombart to discuss your legal options.
Unintended child pornography charges can root from unknowingly being in possession of child pornography on a website to sexting. Sexting is a recent trend of teenagers using cell phones to take and send nude or semi-nude photos of themselves to friends or significant others.
